AutoMate AI - Terms of Service

1. Acceptance of Terms

By downloading, installing, or using AutoMate AI ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

The App is operated by TWINCAP LIMITED, a company registered in Scotland (company number SC878120), with its registered office at Munro House, Quarrywood Court, Livingston, EH54 6AX. These Terms form a legally binding agreement between you and TWINCAP LIMITED.

2. Description of Service

AutoMate AI is a vehicle management application that helps UK car owners track MOT expiry dates, road tax renewal dates, insurance reminders, and other vehicle compliance information. The App retrieves vehicle data from the DVLA (Driver and Vehicle Licensing Agency) and DVSA (Driver and Vehicle Standards Agency) public APIs using registration numbers you provide.

You may delete your account at any time from the Settings screen within the App. Upon deletion, all your data will be removed from our servers within 30 days.

4. Subscriptions and Payments

AutoMate AI offers the following paid plans in addition to the free tier:

Subscriptions are processed and managed by Apple (via the App Store) or Google (via Google Play), depending on which platform you use. Payment is charged to your App Store or Google Play account at the time of purchase.

Subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before the renewal date. You can manage or cancel your subscription at any time through your device's App Store or Google Play subscription settings. TWINCAP LIMITED does not handle payment processing directly and cannot issue refunds — refund requests must be made to Apple or Google in accordance with their respective policies.

We reserve the right to change subscription prices. We will provide reasonable notice of any price changes before they take effect.

Separately from subscriptions, CarXray vehicle history checks are available as one-off in-app purchases (£19.99 per check). These are governed by section 7 (CarXray Vehicle History Checks) below.

6. DVLA Data and Accuracy

Vehicle compliance data (MOT expiry, tax status) is retrieved from official UK government APIs (DVLA/DVSA). While we make every effort to display accurate information, we cannot guarantee that data returned by these APIs is always complete or current. You should always verify critical compliance information directly with the DVLA or DVSA before making decisions.

AutoMate AI is an informational tool and does not constitute legal or regulatory advice. You remain solely responsible for ensuring your vehicle is compliant with all applicable UK laws.

7. CarXray Vehicle History Checks

CarXray is an optional paid feature that produces a vehicle history report for a single UK-registered vehicle. Each CarXray check is a one-off purchase (a "consumable") priced at £19.99 per check; it is not a subscription and does not renew. One purchase entitles you to one report for one vehicle, generated at the time of purchase and saved as a PDF on your device. A CarXray report may include a stolen/police marker check, outstanding finance, insurance write-off category, mileage anomaly detection, an estimated valuation, and the vehicle's full MOT history.

Data sources and third-party information. Vehicle history data in CarXray reports — including finance agreements, insurance write-off records, keeper-change history, mileage records and valuation — is provided by Experian. Other information may be supplied by third parties including the DVLA, DVSA, UK police databases and the Motor Insurers' Bureau. We do not control, and are not responsible for, the accuracy, completeness or timeliness of data supplied by these third parties, and there may be a delay before their records are updated. Certain data is supplied subject to the relevant provider's own terms. CarXray draws on UK data sources only; for a vehicle previously registered outside the UK, a report covers only the period since its UK registration.

No warranty; the report is a snapshot. CarXray reports are provided on an "as is" basis and reflect the data available to us at the moment the report is generated. We make no representations or warranties as to their accuracy or completeness and cannot guarantee that they are free from errors or omissions. We do not offer a separate data guarantee or indemnity in respect of CarXray reports.

Not advice; you make your own decision. A CarXray report is provided for general information only. It is not financial, legal or professional advice, and is not a recommendation to buy or not to buy any vehicle. You should not rely on it alone — you remain solely responsible for your own inspection, independent checks and purchase decision.

Permitted use of the report. Your CarXray report is licensed to you for your own personal, non-commercial use in connection with a single vehicle. You may show a copy to the seller or buyer of that vehicle as part of a transaction, but you may not otherwise resell, redistribute, republish or commercially exploit the report, nor use automated means (such as scraping or bots) to extract data from the service. All intellectual property in the report, its format and the underlying data compilation belongs to TWINCAP LIMITED or its licensors.

Payment, cancellation and refunds. CarXray checks are purchased through the Apple App Store or Google Play. Because the report is digital content supplied immediately on request, you expressly consent to its immediate supply and acknowledge that you lose your statutory 14-day right to cancel once the report has been generated. Any refund of the purchase price is handled by Apple or Google under their respective refund policies — TWINCAP LIMITED does not process payments or issue refunds directly. The price shown (£19.99) may vary by territory and currency in line with app store pricing, and availability depends on the app store.

8. Intellectual Property

The App, including its design, code, branding, and content, is owned by TWINCAP LIMITED and protected by copyright and other intellectual property laws. We grant you a limited, non-exclusive, non-transferable licence to use the App for personal, non-commercial purposes in accordance with these Terms.

You may not copy, modify, distribute, sell, or sublicense any part of the App without our prior written consent.

9. Privacy

Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Vehicle registration numbers are sent to the DVLA API to retrieve compliance data. Documents you store (photos, PDFs) are saved locally on your device only and are never uploaded to our servers.

10. Limitation of Liability

To the fullest extent permitted by applicable law, TWINCAP LIMITED shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the App, including but not limited to:

Our total liability to you for any claim arising from use of the App shall not exceed the amount you paid to us in the 12 months preceding the claim.

Nothing in these Terms limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded by law.

11. Termination

We may suspend or terminate your account and access to the App if we determine, in our sole discretion, that you have breached these Terms or that continued access poses a risk to other users or our services. We will endeavour to provide notice where reasonably practicable.

You may stop using the App and delete your account at any time. Termination does not entitle you to a refund of any prepaid subscription fees.

12. Governing Law

These Terms are governed by the laws of Scotland. Any disputes arising out of or relating to these Terms or your use of the App shall be subject to the exclusive jurisdiction of the courts of Scotland. If you are a consumer, this does not affect your statutory right to bring proceedings in the courts of the part of the UK in which you live.

13. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will notify you via an in-app notice before the changes take effect. Your continued use of the App after changes become effective constitutes your acceptance of the revised Terms.

The date at the top of this page indicates when these Terms were last updated.
